General terms and conditions

Scope

These Terms and Conditions (‘ Terms ‘) apply to all contracts covered by Seven Seals Innovation AG, CHE-105.749.258, (‘ Seven Seals Innovation AG ‘) with persons or companies domiciled in Switzerland or in the Principality Liechtenstein (‘ Customer ‘) closes products (‘ Products ‘) offered in the Seven Seals Innovation AG webshop (‘ Webshop ‘) below. By placing an order in the web shop of Seven Seals Innovation AG, the customer accepts these terms and conditions.
Deliveries, services, offers etc. from Seven Seals Innovation AG via the webshop are made exclusively in accordance with these terms and conditions. The terms and conditions apply in the current version at the time of conclusion of the contract. Seven Seals Innovation AG reserves the right to change these terms and conditions at any time.

User account / customer details

The customer places orders via a user account or as a guest in the web shop of Seven Seals Innovation AG. All information provided by the customer in the user account and all information as a guest must be complete and true. Each customer is only allowed to open one user account.

Conclusion of contract and delivery

The contract between Seven Seals Innovation AG and the customer is only concluded by an explicit order confirmation (not by the automated summary of the order sent by e-mail) or by the dispatch confirmation of Seven Seals Innovation AG and is conditioned by the availability of the ordered products. Until the time of the express confirmation of the order or the confirmation of the letter by Seven Seals Innovation AG, the buyer remains bound to the order.
The offer of Seven Seals Innovation AG is primarily aimed at end users, which is why Seven Seals Innovation AG reserves the right not to fulfill or reject orders, especially if, from the point of view of Seven Seals Innovation AG, not fine-consumption Quantities of products are ordered.
The prices in Swiss francs, which are valid in the website at the time of the order date, are valid for the products ordered by the buyer, including VAT and exclusive shipping costs, provided that the total order value (excluding VAT) does not exceed CHF 100.00. Shipping costs are reported separately during the order process and in the order confirmation.
Seven Seals Innovation AG supplies exclusively to delivery addresses within Switzerland or the Principality of Liechtenstein. Shipping and packaging type are determined by Seven Seals Innovation AG. Partial deliveries are permitted, resulting in additional shipping costs borne by Seven Seals Innovation AG.
Delivery termin-and deadlines specified by Seven Seals Innovation AG are non-binding. If the delay is more than twenty days or if there is an impossibility of delivery for more than twenty days, the customer and Seven Seals Innovation AG are entitled to withdraw from the contract without compensation.

Terms of payment

All orders must be paid for in Swiss francs, either by invoice or credit card.
Bills of Seven Seals Innovation AG must be paid within 30 days (without deduction). From the third reminder, Seven Seals Innovation AG will charge an increase in the amount of CHF 40.00.
In the case of orders against the invoice, Seven Seals Innovation AG is entitled to demand advance payment without giving reasons (e.g. due to insufficient creditworthiness).
In the event of payment against invoice, the ownership of the delivered goods will only be transferred to the customer after full payment of the purchase price.

Inspection, warranty and liability

The customer must immediately check the received consignments or products for correctness, completeness and freedom from defects. Any deviations to the order and any defects must be communicated in writing within 5 calendar days of delivery of Seven Seals Innovation AG.
Seven Seals Innovation AG only guarantees that the products ordered do not have any defects in terms of materials and/or processing at the time of delivery to the customer. Any defects must be reported to Seven Seals Innovation AG in writing, with detailed description of the defects and sending the full defective product and the dated proof of purchase in case of private use of the product within 2 years from the date of purchase (in the webshop) Be notified. In case of commercial use, a defect must be reprimanded within 1 year from the date of purchase (in the webshop), otherwise there is no warranty obligation of Seven Seals Innovation AG.
Use and consequences of improper or improper use, failure to maintain and attempts at repair by the customer or third parties do not constitute defects.
The warranty obligation may be fulfilled by Seven Seals Innovation AG at its discretion by repair, replacement (by an identical or similar device), purchase price reduction or by refund of the purchase price. Other benefits, in particular damages, are excluded in the event of a defect.
With the purchase, the customer undertakes to use the products solely according to the purpose of use.
Any further liability of Seven Seals Innovation AG in connection with products or services of Seven Seals Innovation AG and its auxiliaries is excluded, to the extent permitted by law.

Data security and data protection

The data transfer takes place via the Internet. The Internet is an open network accessible to everyone and is therefore generally not considered a safe environment. All payment transactions are processed in accordance with the standard of security (“https://”), which is customary at the time of the transaction. Seven Seals Innovation AG disclaims any liability for the security of data during its transmission via the Internet.
The processing of personal data is carried out in accordance with and in compliance with the applicable data protection regulations for the purpose of processing the contract and maintaining relations with the customer (including marketing measures).
The disclosure of the customer’s personal data to third parties outside Seven Seals Innovation AG takes place exclusively to the service partners involved in the contract processing, such as the logistics company entrusted with the delivery. In such cases, the amount of data transmitted is limited to the minimum required for the contract to be concluded. No further disclosure of customer data to third parties will take place. The customer agrees to the collection, processing and use of his personal data in accordance with the above instructions.
In addition, the conditions for the use of the website of the web shop, which can be accessed under the heading of data protection, also apply to the purchasers.

Applicable law and place of jurisdiction

The contractual relationship, incl. these Terms and Conditions, subject exclusively to Swiss law, excluding the conflicting provisions of Swiss international private law, in particular excluding the United Nations Convention on Contracts on the United Nations International sale of goods (Viennese right to buy). Jurisdiction is Stans, NW, Switzerland, where Seven Seals Innovation AG is entitled to take the customer to its general court.
